How to Register a Business Name in Sydney (NSW Guide)

Have you come up with the perfect name for your new Sydney cafe or consulting firm? Before you order the sign or print the business cards, you need to make it official.

Registering a business name in Australia is a national process managed by ASIC, but there are specific steps you should take for NSW compliance.

Step 1: Check Availability

Use the ASIC Connect search tool to ensure the name isn't taken. You should also check the IP Australia trademark database. Just because a name is available with ASIC doesn't mean you have the trademark rights to use it.

Step 2: Get your ABN

You cannot register a business name without an Australian Business Number (ABN). You can apply for this for free at abr.gov.au. If you are setting up a company (Pty Ltd), you will get an ACN first, then an ABN.

Step 3: Register via ASIC

Once you have your ABN, log into ASIC Connect and register the name.
Cost (2026): Approx $44 for 1 year or $103 for 3 years.

Step 4: NSW Specifics (Fair Trading)

While the business name is national, you may need to register for specific NSW licenses depending on your industry (e.g., Fair Trading NSW for builders or real estate agents).
